The Texas Family Code states that the best interest of the child is the court's primary consideration. That sentiment is mirrored at Saumier Law Firm, P.C. In pursuit of that goal, we strive and encourage an amicable resolution, and use our experience and knowledge to guide and counsel our clients on how to achieve such a result. But, experience tells us that all too often the parents cannot agree on what is in the best interest of their children, and we are prepared to litigate issues concerning possession and access with children.

Paternity

If a child is born out of wedlock, seeking paternity of a child will ensure that both parents will be in the child's life.  Whether you plan on marrying the other parent in the future, once paternity has been established, it allows both parents to have possession and access with the child and will ensure that both parents are financially responsible for the child.

There were several changes in the Texas Family Code in 2011 that affect the issue of paternity. If you are the mother of the child and the father denies paternity, we can help you. If you are being accused of being the father of a child and you don't believe that you are the father, we can help you. If you are already ordered to pay child support for a child and you have since learned that you are not the child's father, we can help you; however, if you delay you may waive your right to contest the prior court order.

Termination/Adoption

Adoption is often referred to as the happiest thing we can do as family lawyers. Helping create a family unit and seeing the smiling faces as the judge signs the adoption order is one of the most gratifying and rewarding things we see in family law. However, there are many legal obstacles that must be cleared before that happy event. At Saumier Law Firm, P.C., we have the experience it takes to make your adoption a reality.

Often, prior to the granting of an adoption, a parent's rights must first be terminated. A minor child can have only one mother and one father. Perhaps you have not heard from the other biological parent in years and your current spouse has helped raise your child as their own, and you and your spouse desire to raise your child together with all parental rights. At Saumier Law Firm, P.C., we have experience in such matters and have helped many people go from stepparent to parent.

Protective Orders

Unfortunately, sometimes a spouse or person in a dating relationship ends up being the victim of family violence. Even worse, sometimes it is the children who have been abused. Family violence is never acceptable, and you can apply for a protective order to protect you and/or your children from such violence. A protective order takes control away from the perpetrator and puts the control in your hands, giving you peace of mind and the sense of security you and your children desire and deserve.

Sometimes, however, one party falsely accuses the other parent or spouse of family violence in hopes of getting a "leg up" in a family law case. If you have been falsely accused of committing family violence, it is imperative that you hire an attorney who understands the burdens of proof and how to defend against such false accusations. At Saumier Law Firm, P.C. we are experienced in protecting persons falsely accused of committing family violence in family law cases.

Enforcement

If you have a court order and the other parent violates the order by denying you court-ordered time with your children or doesn't pay the child support ordered, you have the right to file a suit to enforce the prior order. Enforcement for denial of possession and access with your children and for failure to pay child support can result in contempt of court resulting in jail time and fines against the contemnor. You are also entitled to have the contemnor pay your attorney's fees in most cases. If the other party to your court order is violating the order, you need the experience of Saumier Law Firm, P.C. to assist you in getting the result you and your children deserve.
